MVUP Before Holiday LLP (Operating under the brand “Before Holiday”)

1. Introduction

Welcome to Before Holiday. These Terms & Conditions govern your use of our website (before.holiday) and all travel services booked through us. By making a booking, you confirm that you have read, understood, and agreed to these terms.

2. Booking & Pricing

2.1 Price Validity

All prices displayed on our website are final, inclusive of all taxes and our service fees, and valid for the specified dates and occupancy. Prices are subject to availability at the time of booking confirmation.

2.2 Booking Confirmation

A booking is confirmed only after:

  • Receipt of the required advance payment.
  • Issuance of a booking confirmation email with a unique booking reference number.

3. Payment Terms

3.1 Payment Schedule

  • Advance: A deposit (typically 25-50%) is required to secure your booking. This deposit is applied toward your total package cost.
  • Balance Payment: The remaining amount must be paid 35 days prior to departure.
  • Cancellations: If you cancel your booking, your deposit and any payments made are subject to the cancellation fees outlined in our Refund & Cancellation Policy.

3.2 Accepted Payment Methods

We accept credit/debit cards, bank transfers, and UPI. All transactions are secured via SSL encryption.

4. Changes by You

4.1 Amendment Requests

Requests to change travel dates, accommodations, or itinerary must be submitted in writing. Changes are subject to availability and supplier penalties, plus an administrative fee of ₹1,000 per change.

4.2 Name Changes/Transfers

Transfers to another person may be permitted if allowed by airlines/hotels, subject to fees. The new traveler must accept these terms.

5. Cancellation by You

All cancellations must be in writing. Cancellation charges will apply as per our Refund & Cancellation Policy (available at https://before.holiday/refund-and-cancellation).

6. Changes or Cancellation by Us

6.1 Minor Changes

We reserve the right to make minor changes to your itinerary (e.g., hotel room category, transportation timing) without compensation, provided the overall standard is maintained.

6.2 Significant Changes or Cancellation

If we must make a significant change (e.g., change of resort, destination, or departure time by more than 12 hours) or cancel your holiday:

  • We will notify you immediately.
  • You may choose to:
    a) Accept the changed arrangements,
    b) Purchase an alternative holiday from us (with price adjustment), or
    c) Receive a full refund of all monies paid within 7 business days.
  • We will pay compensation as per industry standards unless the change is due to force majeure.

7. Our Responsibility

7.1 Role as Agent

Before Holiday acts as an agent for travel service providers (hotels, airlines, transport operators, etc.). We are responsible for the proper provision of the booking services we contract to arrange.

7.2 Supplier Services

We are not liable for the acts, omissions, or service quality of independent suppliers. However, we will provide reasonable assistance in resolving disputes with suppliers.

7.3 Limitation of Liability

Our maximum liability for any claim relating to our services is limited to the total amount paid for your booking. We are not liable for indirect, consequential, or incidental damages.

8. Your Responsibilities

8.1 Travel Documents

You are solely responsible for obtaining and carrying valid passports, visas, health certificates, and other required documents. We are not liable for delays or denials due to inadequate documentation.

8.2 Travel Insurance

We strongly recommend purchasing comprehensive travel insurance covering cancellation, medical expenses, personal liability, and loss of baggage. You may purchase insurance through us or independently.

8.3 Conduct

You agree to comply with local laws, respect customs, and behave responsibly. We may terminate your holiday without refund if your behavior endangers or inconveniences others.

9. Force Majeure

We are not liable for failure to perform obligations due to events beyond our reasonable control, including but not limited to:

  • Natural disasters, extreme weather
  • War, terrorism, civil unrest
  • Government restrictions, border closures
  • Pandemics, epidemics
  • Strikes, industrial action
    In such cases, we will work with you and suppliers to find reasonable solutions, which may include future travel credits.

10. Complaints

If you have a complaint during your holiday:

  1. Inform our local representative or contact us immediately.
  2. If unresolved, submit a written complaint within 28 days of trip completion to:

11. Privacy

Your personal data is protected as per our Privacy Policy (available at https://before.holiday/privacy-policy).

12. Governing Law & Jurisdiction

These terms are governed by Indian law. Any disputes shall be subject to the exclusive jurisdiction of courts in Gautam Buddha Nagar, Uttar Pradesh, India.

13. Amendments

These Terms & Conditions may be updated periodically. The version applicable to your booking is the one published on our website at the time of your booking confirmation.

14. Acceptance

By proceeding with payment, you confirm that:

  • You are at least 18 years old.
  • You have read and accepted these Terms & Conditions.
  • You consent to our use of personal data as per our Privacy Policy.
